TERMS OF BUSINESS

All quotations, purchasing of goods and installation services made by Osborne Jones Log Burners & Stoves Ltd will be deemed to incorporate the below terms and conditions unless clearly stated in writing otherwise.   

 

  1. Contract of sale 

a) As with all natural materials such as slate, stone, marble and granite minor markings or unusual grain patterns can be present, these are not defects but part of the natural character of the cut material.  

b) Any costings and arrangements for products/installation are strictly between us (Osborne Jones Log Burners & Stoves) and you (The Client) unless otherwise stated in verbal or written confirmation involving any other company.  

c) Osborne Jones Log Burners & Stoves may introduce or recommend a company or individual ie scaffolding ect. You are free to obtain other quotes for partial works from a third party, however any work carried out by them will be solely their responsibility, under no circumstance will we be responsible for any work undertaken or damage that may be caused by them as a subcontractor. Including plasterers.

d) Payment for all materials and/or installation is stated as 20% payable prior to the ordering of goods then 50% 2 weeks before installation and the remaining payable on the day of installation, unless otherwise stated. Osborne Jones Log Burners & Stoves reserve the right to reserve full payment in advance at their sole discretion. 

e) Ordering of goods and any other works will not be undertaken until the 20% deposit or 50% payment has been received. Deposits and full payment are not refundable once goods have been ordered. 

f) Deposits will be refundable in full, should you (The Client) decide that you do not wish to proceed with the sale only if goods have not been ordered. If goods (or part of) have been ordered / delivered the client will bear the restocking charge, delivery charge, courier charge and any other related charges that are incurred due to the item being returned to the supplier. 

g) All items manufactured by others and supplied to Osborne Jones Log Burners & Stoves and then passed or sold to the client will be covered by the relevant manufacture’s general guarantee (slate, marble and granite, being natural products, do not carry any form of guarantee for natural occurrences). 

h) It is your (The Clients) sole responsibility to ensure that all required work is conducted prior to installation of the new Stove/Installation 

i) It is your (The Clients) sole responsibility to ensure that chimneys are swept and inspected prior to installation of any stove by a competent person/persons. 

 

  1. Installation 

a) In the case of unforeseen problems, you (The Client) remain wholly responsible for full payment of the outstanding balance on installation of the goods as stated in section (3a) irrespective of any other work undertaken by third parties. This includes any extra site visits added on to the original installation time we had allocated.  

b) We Osborne Jones Log Burners & Stoves reserve the right to change fitting dates to accommodate situations out of our control. 

c) You (The Client) will ensure reasonable access to the property to ensure installation within a mutually agreed time period, if access is denied then we reserve the right to invoice for the full balance immediately. 

d) We Osborne Jones Log burners & Stoves will not be held responsible for any decoration being disturbed, marked or damaged during the installation of works carried out. This includes any dust settlement or dust from works carried out. It is the clients sole responsibility to cover any personal belongings prior to installation.

e) We Osborne Jones Log Burners & Stoves do not remove any waste that has come from works carried out by our installation team, however all waste materials will be bagged up in rubble sacks and left in an agreed place for you to dispose of.  

f) Access to chimney – if safe to do so we can access your chimney using roof ladders. Roof ladders put pressure on roof tiles and slate and sometimes in a small percentage of installations can cause them to break or crack. To avoid this we recommend using an access company ie scaffolding, this will be the client’s discretion and we will not be liable for any damage caused using roof ladders. Any third party access company is liable for their work, so any damage caused by a third party should be taken up with them directly.

g) If we are unable to hang an oak beam due to any plastering being booked in post installation. We will remove this oak beam cost from our invoice and the remaining invoice will still be payable as per our terms and conditions.

 

  1. Removal or adjustments of existing fireplace 

a) Whilst every care and considerations will be given to an existing fireplace, We Osborne Jones Log Burners cannot be held responsible for any damage incurred during the removal of the same.

 

  1. Post Installation 

a) Any remaining balance is payable ON THE DAY once the installation is complete and to be paid onsite via card or bank transfer before our fitters leave. Unless stated/agreed otherwise.  

b) It is solely your (The Client’s) responsibility to insure the stove installed receives regular maintenance. Refer to section 6a. 

c) If any issues arise to (the clients) chimney post installation where we are called out to investigate, and it is deemed not to of been caused by any part of the installation work carried out. There will be a standard callout charge applied (£100 + VAT) 

 

  1. Mulifuel & Woodburning Stoves supplied by us

a) The following items on any Multifuel or wood burning stove are NOT covered under warranty, grate bars, stove glass, door seals, paint, rope, gaskets, handles, firebricks, baffle plates and hinges and anything that is classed as perishable. Please refer to your manufacturers warranty if your unsure.

b) Servicing, all solid fuel appliances must be serviced once within every 12 month period and swept at least once if using smokeless fuel. 

c) £100 plus vat standard call out charge will be applied for any misuse of the multi-fuel stove or wood burner. 

 

  1. Warranty

a) 12 months fitting warranty – We Osborne Jones Log Burners & Stoves provide all installations with a 12 month fitting warranty this includes, any problems that may arise from the fitting of flue parts and systems. Any connections that were to come loose would be resolved. If we are called out for any reason that is not deemed our responsibility including damage caused by any adverse weather conditions then a standard £100+vat call out will be charged.

b) If you have your yearly sweep and service carried out by us Osborne Jones Log Burners & Stoves we will extend your fitting warranty for another 12 months.

c) Manufactures stove warranty – please refer to your stoves instruction manual this will state what they cover you for.  All though we supply the stove we can only cover what the manufacturer states. We will assist with any claim made where possible.

 

Chimney Sweeping Terms  

a) Any damage to fire bricks when carrying out the sweep will be chargeable as they are susceptible to cracking with high temperatures but may only crack when moved.  

b) In a very small number of cases a flue system that has a tear in can get further damaged upon sweeping. This cannot be avoided as any small tears are not visible without cctv inspection carried out first. We do recommend having a cctv inspection on your sweep to ensure everything is in working order and is safe to continue using.  

c) All soot is classified as household waste and will be bagged up and left to dispose of by client.  

d) Chimney sweeping and inspection carried out by Osborne Jones Log Burners & Stoves is done so with the utmost care however we cannot be held responsible for objects dislodged or unsettled either inside or outside of the chimney during any works.
